The role of the Codes SEPP was originally envisaged toenable minor, low impact development as complying development, where approvalby an accredited certifier would not require merit assessment. Unlike SEPP 65and the Apartment Design Guide, the proposal to introduce medium densityhousing and the supporting design guide, would override local planning controlsand provide no provision for the preservation of localcharacter. The waste management requirements for the proposal would beaddressed in development applications for future dwelling houses on theproposed lots.
On at least one occasion in every12 month period following the date of the first ‘Fire SafetyCertificate’ issued for the property, the owner must provide Council withan annual ‘Fire Safety Certificate’ to each essential serviceinstalled in the building. A detailed geotechnicalassessment of the site by a chartered structural engineer is to be undertakenfor the design of the excavation, ground vibration, excavation support, designparameters for support systems and anchor design, groundwater and  foundationdesign. The proposed first use of theproposed units would be consistent with the requirements of the Exempt &Complying SEPP to enable future change of use as Complying Development. The proposed signs are satisfactory in respect to SEPP 64and in this regard meet the prescriptive measures of HDCP. The proposed development would meet the HDCP desiredoutcomes for vehicle access and parking. The proposed 16.4m-21.3m rearsetback exceeds the minimum 10m rear setback in providing for the conservationof bushland and the sandstone escarpment area at the rear of the site.
Subject to recommended conditions the proposed developmentwould meet the HDCP desired outcome for landscaping. Subject to the implementation of sediment and erosioncontrol measures and stormwater management to protect water quality, theproposal would comply with the requirements of the Policy. The application proposes the construction of a part two andpart three storey industrial building containing 17 units, strata subdivision,signage and first use of the units. A certificate must be submittedto the PCA by a practicing landscape architect, horticulturalist or person withsimilar qualifications and experience certifying that all required landscapingworks have been satisfactorily completed in accordance with the approvedlandscape plans. The application is recommended for approval subject toconditions in Schedule 1 of this report. The proposed rear setbacks are acceptable with regard to theopen aspect of the adjoining school site and the existing screen planting alongthe boundary, as discussed in Section 2.9.6.

The site depth would not readilyaccommodate a five storey RFB in accordance with the HDCP designprescriptive measures and comply with the front and rear setback criteria. As detailed in the above table, the proposed developmentdoes not comply with a number of prescriptive requirements within the HDCP. The matters of non-compliance are detailed below, as well as a brief discussionon compliance with relevant desired outcomes.
